MLC公约2022年修正案，将于2024.12.23生效。这个修正案，将对船员和船东，产生一定的影响。

这个修正案里，受船员关注的一条，是标准A3.1-起居舱室和娱乐设施中经修订的第17款：为了所有海员的利益，在船上应提供适合满足必须在船上工作和生活的船员的特殊需求的适当海员娱乐设施、福利设施和服务，包括社交连接，同时考虑规则4.3和相关守则中关于保护健康和安全、及防止事故的规定(Appropriate seafarers’ recreational facilities, amenities and services, including social connectivity, as adapted to meet the special needs of seafarers who must live and work on ships, shall be provided on board for the benefit of all seafarers, taking into account Regulation 4.3 and the associated Code provisions on health and safety protection and accident prevention.)

在导则B3.1.11-娱乐设施、邮件和上船探访安排中，插入新的第8款：在合理并切实可行范围内，船东应向船上海员提供互联网接入服务，收费（如有）金额应合理(Shipowners should, so far as is reasonably practicable, provide seafarers on board their ships with internet access, with charges, if any, being reasonable in amount.)

上面的“社会连接”和“合理并切实可行”如何理解，尚没有看到IMO的进一步说明或统一解释。

公约第六条，关于规则以及守则之A部分和B部分中，明确说明：规则和守则A部分是规定具有强制性。守则B部分为非强制性。所以我们不能拿导则B部分的要求，去强制要求船东或船员。

日前巴拿马船旗国发布的第MMN-06/2024号通告中，关于MLC2022年修正案，明确了以下几点：

1、该修正案没有修正MLC公约附录A5-I(在根据标准A5.1.3第1款向船舶发证前必须经过检查，并经船旗国批准的海员的工作和生活条件)。

2、该修正案没有修正MLC公约附录A5-II（海事劳工证书、DMLC PART I & PART II）。

3、该修正案没有修正MLC公约附录A5-III（成员国港口的授权官员在根据标准A5.2.1开展港口国检查时，将进行详细检查的一般范围）。

ClassNK在其2024.6.28发布的第TEC-1327号通函里也说明：

1、截止目前为止，还没有船旗国发布如何实施修正案的通函(the handing of the amendments have not yet been issued by any flag states).

2、除非船旗国要求，不必明确说明达到修正案要求的措施(Unless the flag states require, it will not be necessary to explicitly state measure, and/or etc. to ensure the revised requirements.)
